Drink Driving Offences

If you have been charged with a Drink Driving you may already be aware that there are varying levels of drink driving based on a range. The range is based on the blood alcohol concentration (BAC) at the time of your breath analysis. The higher the range the more serious the penalty you may suffer.

The range of BAC of your charge will be recorded in the Certificate of Analysis, a copy of which should have provided to you by the Police when you provided a breath sample either at a mobile police unit or the Police Station.

Penalties
Low range drink driving

If a person is found guilty of drink driving in Queensland, and it is their first offence then the maximum suspension period ranges from three months to 12 months, depending on whether it is a low-range, medium-range or high-range offence. The maximum fine ranges from $2012 to $4025.

Penalties
Mid range drink driving

Mid-range drink driving is the second most serious drink driving offence under Queensland law and carries a maximum penalty of 6 months imprisonment and/or 20 penalty units for a first offence. You will also be required to participate in the interlock program.

Penalties
High range drink driving

High-range drink driving is the most serious drink driving offence under Queensland law and carries a maximum penalty of 9 months imprisonment and/or 28 penalty units for a first offence. You will also be required to participate in the interlock program.
